Terms of Service

Keepsakes ("Keepsakes", "we", "us") is a web application that helps you organise travel photos, collaborate with fellow travellers, and create professionally printed square hardcover photo books delivered to your door.

The service is provided as-is subject to these Terms. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

• You must be at least 18 years old (or 13 with verifiable parental consent in jurisdictions that permit it) to use Keepsakes.
• You must provide accurate information when creating an account. You are responsible for keeping your account credentials secure.
• You may not share, sell, or transfer your account to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the service.

You agree to use Keepsakes only for lawful purposes. You must not:

• Upload content that infringes the intellectual-property rights of others.
• Upload photos of individuals without their consent, or use the service to process biometric data unlawfully.
• Upload content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse-engineer, scrape, or disrupt the service or its infrastructure.
• Use the service to send unsolicited communications or invitations to collaborators who have not consented.
• Create accounts by automated means or under false identities.

You retain full ownership of all photos, text, and other content you upload to Keepsakes ("Your Content").

By uploading content, you grant Keepsakes a limited, non-exclusive, royalty-free licence to store, process, and reproduce Your Content solely for the purpose of providing the service to you — including generating book layouts, transmitting print-ready files to our print partner, and displaying previews to you and your collaborators.

• We will never sell, license, or share Your Content with third parties except as needed to fulfil your order (print partner) or as described in our Privacy Policy.
• We do not use Your Content to train AI or machine-learning models.
• You represent that you have the right to upload all content you provide and that it does not violate any third-party rights or applicable law.

You can invite other people ("Collaborators") to contribute photos to your project by sharing an invitation link. By inviting someone, you confirm you have their consent to share their email address with us for the purpose of sending the invitation.

Collaborators who accept an invitation agree to these Terms and our Privacy Policy. You, as the project owner, are responsible for managing and revoking collaborator access through your dashboard.

• All prices are displayed in your local currency and include applicable taxes where required by law. Prices are subject to change; changes will not affect confirmed orders.
• Payment is processed securely by our payment provider. We do not store your card number.
• Your order is confirmed when you receive an order-confirmation email. We reserve the right to cancel or refuse orders at our discretion (e.g., in cases of suspected fraud), in which case we will issue a full refund.
• Delivery times are estimates and may vary by destination. We are not liable for delays caused by customs, postal services, or circumstances beyond our control.
• Books are printed to order. We do not hold stock.

• Before print: You may cancel your order for a full refund at any time before we send the print file to our print partner (typically within 1 hour of order placement). Contact us immediately at hello@keepsakes.photos.
• After print: Because each book is printed on demand to your specification, we cannot offer refunds for change of mind once printing has begun.
• Damaged or incorrect books: If your book arrives damaged or contains a printing error on our part, contact us within 14 days of delivery with photos of the issue. We will reprint or refund at our discretion.
• Lost in transit: If your book has not arrived within 30 days of the estimated delivery date, contact us and we will investigate and re-ship or refund as appropriate.

The Keepsakes application, brand, logo, design, and technology are owned by or licensed to Keepsakes and are protected by copyright and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works from our platform without our express written permission.

Open-source components used by the service are governed by their respective licences.

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

We do not guarantee that the service will be error-free, uninterrupted, or secure, though we take reasonable steps to maintain reliability and security.

Printed photo-book colours may vary slightly from on-screen previews due to differences between display calibrations and print processes — this is inherent to photo printing and does not constitute a defect.

To the fullest extent permitted by applicable law, Keepsakes and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of business, arising out of or related to your use of the service.

Our total aggregate liability to you for any claim arising from the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Keepsakes and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

We may update these Terms from time to time. For material changes, we will notify you by email or by a prominent notice on the site at least 14 days before the change takes effect. Your continued use of the service after that date constitutes acceptance of the new Terms.

If you do not agree to the revised Terms, you may close your account before the changes take effect.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Keepsakes is established, without regard to conflict-of-law principles.

We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be referred to the competent courts of the applicable jurisdiction.
